Effective Date: August 16, 2026. These Terms of Service ("Terms") govern use of the website located at silverdesktech.com (the "Site"), operated by Silverdesk LLC ("Company," "we," "us," or "our"). By accessing or using the Site, including by submitting the intake form described below, you agree to these Terms. If you do not agree, do not use the Site.
1. Nature of the Site
1.1 The Site provides general information about Company's in-home and remote technology support services for older adults and allows visitors to request a discovery call. The Site is informational and lead-generation in nature; it is not itself a platform through which Services are performed, and no Services are provided until a separate Client Services Agreement is signed.
2. No Medical, Financial, or Legal Advice
2.1 Content on the Site, including any educational material regarding scams, technology safety, or senior care, is provided for general informational purposes only and does not constitute medical, financial, or legal advice. You should consult a qualified professional for advice specific to your situation.
3. Intake Form and Submitted Information
3.1 The Site includes a discovery-call intake form (currently hosted via a third-party form provider). By submitting the form, you represent that the information you provide is accurate and that, if you are submitting on behalf of another individual (including a parent or other family member), you have that individual's permission to do so or otherwise have the authority to make this inquiry on their behalf.
3.2 Submission of the intake form does not create a Client Services Agreement or any obligation on Company's part to provide Services. Company will contact you to determine whether Services are a fit for your household.
3.3 Handling of information submitted through the intake form is described in Company's Privacy Policy, incorporated into these Terms by reference.
4. Geographic Scope
4.1 Company currently provides in-home Services only within its published service area. Submission of the intake form from outside that area does not obligate Company to provide Services, though Company may retain your information to contact you if its service area expands, as described in the Privacy Policy.
5. Intellectual Property
5.1 All content on the Site, including text, graphics, logos, and the "Tech Binder," "Silverdesk," and related names and marks, is the property of Company or its licensors and is protected by applicable intellectual property law. You may not copy, reproduce, or create derivative works from Site content without Company's prior written permission, other than for personal, non-commercial reference in evaluating Company's services.
6. Third-Party Links and Services
6.1 The Site may reference or link to third-party services (for example, the form provider used for intake). Company is not responsible for the content, privacy practices, or terms of any third-party site or service.
6.2 The Site is hosted on a third-party platform and uses analytics cookies subject to visitor consent; these are described in detail in Company's Privacy Policy, incorporated into these Terms by reference.
7. Disclaimer of Warranties
7.1 THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW. COMPANY DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.
8. Limitation of Liability
8.1 TO THE FULLEST EXTENT PERMITTED BY GEORGIA LAW, COMPANY WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF THE SITE. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER GEORGIA LAW.
9. Indemnification
9.1 You agree to indemnify and hold Company harmless from any claim arising out of your misuse of the Site or submission of false or unauthorized information through the intake form.
10. Children's Privacy
10.1 The Site is directed to adults and is not intended for use by children under the age of 13. Company does not knowingly collect personal information from children under 13 through the Site.
11. Changes to These Terms
11.1 Company may update these Terms from time to time by posting a revised version on the Site with an updated Effective Date. Continued use of the Site after such changes constitutes acceptance.
12. Governing Law; Venue
12.1 These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms is subject to the exclusive jurisdiction and venue of the state and federal courts located in DeKalb County, Georgia.
